Q. I am married to a U.S. citizen can my spouse sponsor me for a Green Card?

           
  • A: YES: If you are married to a U.S. citizen or a lawful permanent resident, your spouse maybe able to sponsor you for a Green Card. In fact this is the most common way to become a lawful permanent resident of the United States.

Q. what does the application involve?

                      
  • A: Marriage based Immigration Step One: If your husband or wife is a U.S. citizen/lawful permanent resident in most cases the first step is for them to file a "Petition for Alien Relative" and also an "Adjustment of Status" application. Usually it is also a good idea to file for employment and travel authorization at the same time as the adjustment of status application is filed. This stage of the process is crucial and being prepared and knowing what to expect often makes all the difference to the success of an application. That is why it is always a good idea to speak with experienced immigration attorneys who can guide you through the application.
           
  • Step Two: After the application for adjustment of status is approved the foreign national is granted conditional permanent resident status. During the 90 days before the second anniversary of the granting of this status the foreign spouse must file a "Petition to Remove the Conditions on Residence" If this petition is not filed the foreign spouse will loose their lawful permanent resident status. If for some reason the foreign spouse is not able to apply with their citizen/lawful permanent resident spouse to remove the conditions they maybe able to file on their own under certain circumstances.
           
  • Step Three: Citizenship: After three years of continuous residence in the U.S. while in a valid marriage the non citizen spouse of a U.S. citizen can apply for U.S. citizenship. This process is called naturalization and as long as the non citizen meets the other requirements of naturalization, their three years of residence and marriage to a U.S. citizen makes them eligible to become U.S. citizens.
