A: Marriage based Immigration Step One: If your husband or wife is a U.S. citizen/lawful permanent resident in most cases the first step is for them to file a "Petition for Alien Relative" and also an "Adjustment of Status" application. Usually it is also a good idea to file for employment and travel authorization at the same time as the adjustment of status application is filed. This stage of the process is crucial and being prepared and knowing what to expect often makes all the difference to the success of an application. That is why it is always a good idea to speak with experienced immigration attorneys who can guide you through the application.
Step Two: After the application for adjustment of status is approved the foreign national is granted conditional permanent resident status. During the 90 days before the second anniversary of the granting of this status the foreign spouse must file a "Petition to Remove the Conditions on Residence" If this petition is not filed the foreign spouse will loose their lawful permanent resident status. If for some reason the foreign spouse is not able to apply with their citizen/lawful permanent resident spouse to remove the conditions they maybe able to file on their own under certain circumstances.
